Drug trafficking is defined as the illegal cultivation, distribution, sale, or transportation of controlled substances. - Heroin: Four grams
- Morphine or opium: Four grams
- Fentanyl or fentanyl-related substance: Four grams
- Ecstasy or MDMA: One hundred tablets, capsules, dosage units, or the equivalent quantity
Trafficking Penalties
Drug trafficking may result in federal or state-level charges, depending on the circumstances surrounding your offense. State-level sentencing will depend on the controlled substance in your possession and the quantity. Even those who have a clean record can face extensive prison sentences and steep fines.
For example, a first-time offender guilty of marijuana trafficking (more than ten pounds but less than 100 pounds) will be sentenced to at least one year in prison, with a maximum of 10 years and a $10,000 fine. On the other end of the spectrum, if you are guilty of trafficking 10,000 pounds or more of the substance or 10,000 marijuana plants, you will face a minimum mandatory sentence of 25 years, with a maximum sentence of 30 years and a $200,000 fine.
